Terms of Service

1. Agreement

By using PayMohawk (“the Service”), you agree to these Terms of Service. PayMohawk is Mohawk-owned and operated under the Haudenosaunee Confederacy. The Service provides non-custodial cryptocurrency payment processing tools for businesses.

2. Service Description

PayMohawk provides:

  • A hosted BTCPay Server instance for generating Bitcoin and Lightning Network invoices
  • WooCommerce, Shopify, and API integrations for e-commerce platforms
  • Merchant dashboard for managing payments and viewing transaction history

PayMohawk is a non-custodial service. We do not hold, control, transmit, or have access to your Bitcoin, private keys, or funds at any time. We provide software tools — not financial services.

3. Merchant Eligibility

To use PayMohawk, you must:

  • Be a business or sole proprietor selling legal goods or services
  • Provide accurate business information during registration
  • Maintain a valid email address for account communications
  • Be at least 18 years of age

We do not restrict merchants based on industry category codes. Tobacco, cannabis (where legally operated), gaming, and all other legal businesses are welcome.

4. Fees

  • Starter Plan: No monthly fee. 1% transaction fee on processed payments.
  • Pro Plan: $35 CAD/month. 0.5% transaction fee on processed payments.
  • Network fees: Bitcoin and Lightning Network fees are paid by the sender (your customer), not by you. These are not PayMohawk fees.

Fees are subject to change with 30 days written notice to your registered email address.

5. Your Responsibilities

  • Secure your Bitcoin wallet and private keys. PayMohawk cannot recover lost keys or funds.
  • Ensure your business operations comply with applicable laws in your jurisdiction.
  • Provide accurate product descriptions and pricing to your customers.
  • Handle customer service, shipping, returns, and disputes for your own products.
  • Keep your webhook URL and API keys secure.

6. Non-Custodial Disclaimer

PayMohawk does not hold your funds. Bitcoin payments are sent directly from your customer's wallet to your wallet. We generate invoices and facilitate the payment flow through software, but we never have custody of or access to your Bitcoin. If you lose access to your wallet or private keys, we cannot help you recover your funds. You are solely responsible for the security of your Bitcoin wallet.

7. Uptime and Availability

We aim for maximum uptime but do not guarantee 100% availability. Our infrastructure is hosted offshore on enterprise-grade hardware in a privacy jurisdiction. Scheduled maintenance will be communicated in advance. PayMohawk is not liable for losses resulting from service downtime, including missed payments during outages.

8. Termination

Either party may terminate the service relationship at any time. You may stop using PayMohawk at any time — your Bitcoin wallet and funds are unaffected. We may terminate accounts that are used for illegal activity, fraud, or violation of these terms. We will provide notice before termination except in cases of clear illegal activity.

9. Limitation of Liability

PayMohawk provides payment processing software on an “as is” basis. We are not liable for: loss of Bitcoin or cryptocurrency due to wallet security failures; business losses due to service downtime; losses resulting from Bitcoin price volatility; actions taken by third parties including customers, banks, or government agencies. Our maximum liability is limited to the fees you have paid to PayMohawk in the preceding 12 months.

10. Dispute Resolution

Any disputes arising from these terms shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through arbitration in accordance with the laws applicable in the jurisdiction of the Haudenosaunee Confederacy.

11. Changes to Terms

We may update these terms with 30 days notice to your registered email. Continued use of the service after the notice period constitutes acceptance of the updated terms.
